ChaletFinder acts as a portal and a matchmaking service to match holidaymakers with accommodation. We act as an advertising agent and matchmaker for chalet operators. When operators receive a booking, they are contracting with the guest direct and not ChaletFinder and are responsible for enforcing their own terms and conditions.
Unless explicitly stated otherwise, any new features that augment or enhance the current Service shall be subject to these Terms.
Acceptance Of Terms
By using this Website you signify your acceptance of these Terms in return for which we grant you access to the Service. If at any time you do not wish to accept these terms then you should not use this Website.
This Website contains links to other websites and web pages and services operated by us ("Findmea.com Ltd Online Sites"), and your use of each Findmea.com Ltd Online Site is also subject to these Terms and the other terms and guidelines (if any) contained within each Findmea.com Ltd Online Site. In the event that any of the terms, conditions and notices contained herein conflict with the terms and guidelines contained within any particular Findmea.com Ltd Online Site, then the terms and guidelines relating to the particular Findmea.com Ltd Online Site shall prevail.
From time to time we may change these Terms. Accordingly, please continue to review these Terms whenever accessing or using this Website. If we change these terms then we will endeavour to post a notice on this Website drawing the changes to your attention.
We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
ChaletFinder provides space for you to display information about your holiday property to prospective guests, and to generate new Direct enquires and booking referrals.
Direct enquiries are sent to you directly by the prospective guest through your property listing on ChaletFinder. These enquiries are sent via email to the email address set in your admin area. Please note that ChaletFinder does not receive the response that you send to the prospective guest.
ChaletFinder also generates non-direct enquiries that are not property specific. ChaletFinder uses the data about your holiday property to match these enquiries to a holiday property, in order to generate booking referrals. These referrals are passed to you when the guest requests to book the property.
Please note that you are contracting with the guests on your own terms for their potential rental of your property. Chaletfinder.co.uk disclaims all liability (as provided for in law) in respect of communications, transactions and payments carried out between you and the guests referred by ChaletFinder.
ChaletFinder uses the data we hold about your property to match properties enquiries that are not property-specific. It is likely we will be in contact with you throughout the process of dealing with a prospective enquirer to check availability, pricing and answer any specific questions.
We do not take money on your behalf. When a prospective guest requests to book an advertised property, ChaletFinder will send a booking request to both the operator and guest to setup the booking.
Confirmed bookings generated through a referral are subject to an additional fee as agreed in the payment plan selected at the time of setting up property listings.
ChaletFinder operates a two tiered pricing structure.
- £140 per property for 12 months + 5% referral fee
- £75 per property for 12 months + 8% referral fee
Both tiers are VAT applicable.
ChaletFinder reserves the right to change pricing at any time. This will not change any existing agreements in place with advertisers until the time of renewal (usually 12 months).
Pricing tiers cannot be changed by an advertiser during the 12-month advertising period.
All advertisements will auto renew (not including additional advertising). If you do not wish to renew your advertising with ChaletFinder, notification must be sent within 30 days prior to your roll over renewal date. Please send notification of your wishes to firstname.lastname@example.org.
There are no referral fees due on any bookings generated via direct enquiries. The referral fee is applicable on bookings referred to the advertiser by ChaletFinder and due on the total value of the accommodation that is booked through a ChaletFinder referral.
A booking is classed as a referred booking when ChaletFinder has had any intervention in the booking process. This includes:
- Any enquiries that are not direct enquiries generated through a property advert and are generated via email, telephone or live chat.
- If an advertiser does not respond to a direct enquiry and the prospective guest, then contacts ChaletFinder to follow up.
- If a prospective guest has already enquired through an agent or other advertising medium and decides to book through ChaletFinder.
- If the prospective guest is already on the operator’s database or CRM.
- If the prospective guest has booked with the operator previously and is generating a new booking.
- If the prospective guest has been found the property by ChaletFinder and then the guest books directly with the owner via direct enquiry or the owner’s website – in these cases ChaletFinder will provide a log as proof of promotion of the property.
Referral fees are discounted by 50% if:
- ChaletFinder is asked to book a property by a guest that has subsequently already spoken with the operator.
Referral fees are not due if:
- After booking through ChaletFinder, the guest books subsequent trips directly through the operator.
- The guest fails to pay the deposit.
Referral fees are subject to VAT where applicable and invoiced on confirmation of the booking from the operator or guest.
Fees will be charged in the same currency as the confirmed booking.
There is no minimum or maximum referral fee amount.
If the guest cancels the trip after paying a deposit, the referral fees are still applicable but calculated on the amount received by the operator before the cancellation was made.
If the operator cancels the trip after the guest has paid the deposit, the referral fees are still applicable. If ChaletFinder finds the guest new accommodation, the operator is not entitled to any share of new referral fees generated.
Changes to bookings
Referral fee payments are due within 7 days of receipt of the booking balance being paid by the guest and can be made payable by credit/debit card or bank transfer.
For any changes to bookings received by ChaletFinder, the guest will be directed to the operator directly to make changes.
In the case of a booking being changed after the initial referral fee has been invoiced, ChaletFinder will neither issue a refund for a reduction in booking value nor issue a new invoice for any increases in the booking value.
Late payments will incur a 10% penalty charge.
Advertisers are responsible for paying any bank charges for sending payments. ChaletFinder is responsible for any bank charges incurred for receiving payments.
ChaletFinder is subject to no advertising restrictions, other than those set by law.
Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales and you irrevocably agree that the courts of England are to have exclusive jurisdiction in relation to any claim that you may bring against us arising out of a dispute relating to these Terms, this Website or the Service.
